Terms of Service

These Terms of Service ("Terms") govern your access to and use of LoveMates (the "Service"), operated by Oraculum OÜ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using LoveMates, you represent that you meet these requirements and that all information you provide is accurate.

2. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at hello@lovemates.ai of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. The Service

LoveMates generates AI avatars from a photo you upload or from a text description, using third-party image-generation models. Generations are paid for with an in-app virtual currency called Energy, which has no cash value and cannot be exchanged, transferred or redeemed for money.

4. Energy, subscriptions & payments

• Energy is obtained through a paid subscription (credited daily) and, for active subscribers, optional one-time top-ups.
• Subscriptions renew automatically each billing period until cancelled. You can cancel anytime from Settings; access continues until the end of the current period.
• Payments are processed by Stripe. By subscribing you authorize recurring charges to your payment method.
• Prices are in euros and may be subject to VAT or other taxes based on your location; any applicable tax is shown at checkout.
• Refunds and cancellations are governed by our Refunds & Cancellation Policy.
• Prices, plans and Energy costs may change; changes apply to future billing periods and will be communicated in advance where required by law.

5. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy, which prohibits, among other things, illegal content, content depicting minors, non-consensual or deceptive imagery, and impersonation. Violations may result in immediate suspension or termination and, where appropriate, reporting to authorities.

6. Your content & uploads

You retain ownership of the photos and prompts you provide ("Input"). You grant us a limited, worldwide, royalty-free license to host, process and transmit your Input to our model providers solely to operate the Service and generate your avatars. You represent that you have all necessary rights to your Input and that it does not infringe any third-party rights.

7. Generated avatars

Subject to your compliance with these Terms and the Acceptable Use Policy, you own the avatars you generate ("Output") and may use them for personal and commercial purposes. Because Output is produced by AI, similar or identical results may be generated for other users, and the legal status of AI-generated works varies by jurisdiction; we make no warranty regarding copyrightability or exclusivity of Output.

8. Intellectual property

The Service, including its software, design, branding and content (excluding your Input and Output), is owned by Oraculum OÜ and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Third-party services

The Service relies on third parties including Stripe (payments), AI model providers via OpenRouter (image generation) and Google reCAPTCHA (security/captcha). Your use may be subject to their terms, and we are not responsible for their acts or omissions.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. AI models can produce inaccurate, unexpected or offensive results; you are responsible for reviewing Output before use. We do not warrant that the Service will be uninterrupted, error-free or secure.

11. Limitation of liability

To the maximum extent permitted by law, Oraculum OÜ will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Oraculum OÜ from any claims, damages or expenses arising out of your Input, your Output, your use of the Service or your breach of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy, or to comply with law. Upon termination, your right to use the Service ceases; certain provisions survive termination.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

15. Governing law & disputes

These Terms are governed by the laws of Estonia and applicable European Union law, without regard to conflict-of-law rules. The courts of Estonia have jurisdiction — except that, if you are a consumer, you keep the benefit of any mandatory protections of the law of your EU country of residence and may bring proceedings there.

If you are an EU consumer and we cannot resolve a dispute directly, you may refer it to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon, komisjon.ee) or to the consumer-protection body in your own country.
